This document constitutes at the same time (1) the general terms or conditions of use of https://smhub.net, which govern the rules for the use of https://smhub.net, including the conclusion of a contract of sale with a merchant from this electronic store, as well as (2) the agreement between the seller and the customer for the purchase and sale through https://smhub.net

A seller of the sm hub platform can be any person who offers goods or services to third parties for commercial purposes and has concluded a relevant contract for this with sm hub.
3. DEFINITIONS

Buyer – a person aged 18 or over who has entered into a distance purchase and sale contract through the sm hub e-commerce platform.
Seller – sm hub or any other merchant offering goods or services on the e-commerce platform https://smhub.net
https://smhub.net– the UGOMAN platform, through which your goods or services are offered for sale.
The platform – the https://smhub.net domain and its subdomains.
Customer – any natural or legal person or other legal entity that uses the Platform in any way, including but not limited to browsing it, placing orders through it, purchasing, returning goods and performing any other actions through it.
Account – a section of the Platform formed by an email address and password, which allows the Customer to send an Order and which contains information about the Customer and the history of some of his actions on the Platform (Orders, tax invoices, etc.).
Favorites – a section in the account that allows the Customer to create their own lists.
List – a web page in the Customer’s Account in the “Favorites” section where he can add products he is interested in.
Campaign – any commercial message aimed at promoting the Platform, the sm hub brand or certain Goods and/or Services that are available in limited quantities, unless the commercial message expressly states otherwise, for a certain period of time specified by the Seller.
Contract – represents a remote contract concluded between the Seller and the Buyer for the purchase and sale of Goods and/or Services through the Platform, an integral part of which are the present general conditions for using the Platform.
Content includes: All information on the Platform that is accessible through an Internet connection and use of an Internet-connected device; The content of any message from the Buyer to sm hub and/or the Seller sent by electronic means and/or any other available means of communication; Any information provided, in any way, by an employee/collaborator of SM HUB and/or another Seller to the Customer through electronic or other means for its remote transmission; The information related to the Goods and/or Services and/or the applied tariffs by the Seller in a certain period of time; The information concerning the Customers and related to the Goods and/or Services and/or the applicable tariffs from third parties with whom the Seller has entered into partnership contracts in some form; Information about the Seller.
Newsletter – means of periodic information about the Goods and Services and/or promotions offered by the Seller, sent electronically via e-mail.
Transaction – the action by SM HUB to refund the amount paid by the Buyer as a result of cancellation, termination, refusal or non-conclusion of a purchase and sale contract through the Platform, carried out only by bank transfer.
Specifications – all characteristics and/or descriptions of the Goods and Services as set out in their description.
Review – a written evaluation by the owner or user of a product or service, based on the evaluator’s personal experience and skills in making qualitative comments and expressing an opinion as to whether or not the product or service meets the characteristics specified by the manufacturer.
Rating – a method of calculating the level of satisfaction of a given Customer with regard to a certain product. The rating is expressed in the form of stars, and each product can receive a rating of one to five stars. This degree of satisfaction will always be accompanied by the review written by the Customer of a given product or service.
Comment – rating or critical remark at the end of a Review or other comment.
Question – a form of addressing Clients/Buyers in order to obtain information about certain products or services.
Answer – written information that is transmitted to the Customer who asked a question on the Platform, on the page of a certain product. A response is an explanation provided by one Client to another Client within a dialogue.
4. GENERAL PROVISIONS

The General Terms and Conditions of SM HUB are binding for all Clients of the Platform.
Any use of the Platform means that You have (a) carefully familiarized yourself with the general conditions for its use and (b) you have agreed to abide by them unconditionally.
The General Terms and Conditions may be changed unilaterally by SM HUB at any time by updating them. These changes are effective immediately and are binding on all Customers.
SM HUB has the right to make changes to the terms of use at any time at its own discretion or if they are imposed by virtue of an effective regulatory act.
In any case of a change to the general terms and conditions, UGOMAN will inform its Customers about it by publishing the changes on the Platform. In this sense, you as a Customer have an obligation to check for any changes to the general terms and conditions of the Platform each time you use it.
If any of the provisions of these general terms of use of the Platform are found to be invalid or unenforceable, regardless of the reason for this, this does not entail the invalidity or unenforceability of the remaining provisions.
SM HUB and its commercial partners make serious efforts to maintain the accuracy of the information presented on the Platform. However, given the possible technical errors or omissions in this information, SM HUB specifies that the images of the products are illustrative and indicative in nature, accordingly the delivered products may differ from the images.
The features or prices of the products described on the Platform may be changed by the relevant Seller at any time. Due to technical reasons, it is possible that they contain errors, for which SM HUB apologizes to its Customers in advance.
It is possible that, due to limited space and the sequential structure of the information, the product descriptions are sometimes incomplete. However, at SM HUB we strive to provide the most relevant and relevant information.
All goods, including those on sale/sale, are sold and delivered while stocks last, even if not expressly stated on the Platform.
The Platform may contain links to other sites. SM HUB is not responsible for the privacy policy of websites it does not administer, as well as for other information contained therein.
5. CONCLUSION OF CONTRACT

The Customer declares his desire to order and buy the Product and/or Service through the Platform by placing an Order electronically or by phone and which is accordingly registered by himself or by an employee of SM HUB on his behalf.
SM HUB will send a notification to the Customer to register the Order in its system, which does not mean acceptance, confirmation or commitment to its execution. SM HUB makes this notification electronically (email) or by phone.
Therefore, the Seller has the right not to deliver part or all of the Goods or not to perform part or all of the Services of the Order for various objective reasons, including but not limited to the exhaustion of their stock availability. In all cases, SM HUB notifies the Customer of this by e-mail or by telephone. In this case, the sole responsibility of the Seller is to return any previously received price of the Goods or Services.
The distance sales contract between the Seller and the Customer is deemed concluded at the moment the Customer receives his e-mail notification that the Goods from the Order are ready for shipment or the Service can be provided.
The sales contract concluded between the Customer and the Seller consists of these general terms and conditions and any additional agreements between the Seller and the Buyer. Each contract will be accompanied by a warranty certificate issued by the Seller or its supplier for the purchased Goods.
6. ONLINE SALES POLICY
- Access to the Platform for the purpose of registering an Order is allowed to any Customer.
SM HUB reserves the right, at its discretion, to restrict the access of any Customer to the realization of an Order and/or to any of the possible payment methods, if it considers that this would be detrimental to SM HUB in any way. In this situation, the Customer’s only right is to contact the Customer Relations Department of SM HUB to be informed about the reasons that led to the implementation of the above measures. SM HUB is not responsible for any damages that the Customer has suffered or may suffer as a result of this decision, regardless of its correctness or justification.
The Customer has the right to publish opinions about Goods and/or Services, as well as to contact SM HUB at the addresses specified in the “contacts” section of the Platform. Comments or messages that contain profanity or inappropriate language will be removed from the Platform or ignored.
Communication with the Seller can be carried out through direct contact with him or at the addresses indicated on the Platform in the “Contact” section.
In the case of unusually high traffic on the Internet, SM HUB reserves the right to require the Clients to manually enter the validating captcha codes, in order to protect the information published on the Platform.
SM HUB may publish advertising or promotional information about the Goods and/or Services and/or about the promotions offered by it or other merchants on the Platform, for a certain period of time.
All prices of the Goods and/or Services on the Platform are final, announced in BGN (BGN) or Euro (EURO) including VAT and all other taxes or fees required by law.
In the cases provided by law, the price of the Goods, type of electronics, announced on the Platform includes a green fee. In case the Customer/Buyer requests details regarding the exact value of the amount added to the price of the Goods, he should contact the Customer Relations Department of SM HUB.
In the case of online or bank payments, the Seller is not responsible for any costs related to fees, commissions or other additional payments made by the Buyer or his bank in connection with the transaction itself, as well as in cases of currency exchange, applied by the bank that issued the client’s card in cases where the currency is different from BGN. Payment by card to SM HUB is accepted as an international payment by banks in Bulgaria and according to their rules for working with cards and card payments, some banks charge additional fees for such transactions. The costs related to such payments are solely for the account of the Buyer. Therefore, SM HUB recommends its customers to check with their bank for possible additional fees that could be charged to them for online or bank payments for Products sold by SM HUB.
All images placed on the Platform have the sole purpose of creating some idea of the type of Product/Service offered, and not to represent it accurately. Accordingly, it is possible that some of the images of the Goods or Services on the Platform (static/dynamic images/multimedia presentations/etc.) may not correspond to the appearance of the relevant Goods or create a wrong impression of the Service offered. Seller shall not be liable for such discrepancies.
After 14 (fourteen) days from the moment of purchasing a Product or Service, the Buyer may be asked to review the purchased Product or Service. This request will be sent to the e-mail address through which he is registered on his Account. By giving a review, the Customer contributes to the better awareness of other possible Buyers and is actively involved in the development of new services and in the more detailed description of the characteristics of the Products.
7. USE OF SUBCONTRACTORS

The Seller has the right to use subcontractors for the performance of its obligations under the distance purchase contract concluded through the Platform, without the need to notify or obtain the Buyer’s consent for this. The relevant Seller will be liable for the actions of such subcontractors as its own.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
- The Content, as defined in the “Definitions” chapter, including but not limited to logos, any graphic images or inscriptions, commercial symbols, dynamic symbols, texts and/or multimedia content of the Platform, are the exclusive property of SM HUB.
sm hub owns and reserves all intellectual property rights related in any way to the Platform, whether owned or obtained through contractual licenses or in any other lawful manner.
Nothing in the remote contract concluded between SM HUB and the Customer shall be considered as an authorization by SM HUB for the latter to copy, distribute, publish, provide to third parties, modify in any way any part of the Content, including but not only the content of the trademarks, logos, multimedia content of the Platform or descriptions of the Products or Services in any way, including by introducing any content external to the Platform, removing the signs indicating the ownership of SM HUB on The content. The Customer has no right to transfer, sell, distribute materials created by reproducing (copying), modifying or publishing the Content, except with the express consent of SM HUB.
The Customer may copy, transfer and/or use the Content only for personal non-commercial purposes, only in cases where this does not contradict the provisions of this chapter of this document.
The Customer has the right to use the Content for commercial purposes only and only if he has received the written consent of SM HUB for this and only to the part of the Content, to the manner and extent of its use, as well as within the time limits for which this consent is expressly given . Any subsequent or different use of the Content will be considered a breach of this contract between SM HUB and the Customer and a violation of the intellectual property rights of SM HUB, which shall be entitled to hold the Customer responsible for it.
Any use of the Content for purposes other than those expressly permitted in these terms and conditions or in other express written consent given by SM HUB is prohibited.
9. GOODS/SERVICES FOR WHICH THE CUSTOMER HAS NO RIGHT OF REFUSAL
- when delivering goods made to the Customer’s order or according to his individual requirements;
upon delivery of goods which, after being delivered and due to their nature, have mixed with other goods from which they cannot be separated;
10. CONFIDENTIALITY
- The Customer agrees that by providing any of his personal or other data to SM HUB, he agrees that it may be used by the latter for the following purposes by SM HUB: (1) maintaining the Customer’s account, including registering orders , sending ordered products, performing the ordered services, invoicing, resolving disputes with Customers regarding their Orders or considering their requests; (2) sending Newsletters or periodic notifications by e-mail or via SMS; (3) conducting market research, tracking and monitoring sales and customer/consumer behavior.
The Customer agrees to grant SM HUB unlimited access in terms of volume and time to any materials and information it sends to the Seller through or in connection with the Platform, regardless of whether it has placed an Order and completed a transaction through the Platform. SM HUB has the right to use, reproduce, publish, modify, transmit and distribute this information or materials. The Customer expressly agrees that SM HUB may freely use and process for its own purposes the ideas, concepts or know-how that the Customer has provided to it in any way through or in connection with the Platform or the actions/inactions that the Customer has performed through or in connection with the Platform. SM HUB has no obligation to keep the information thus obtained as confidential, to the extent that it is not required to do so by the current legislation.
By providing his data to SM HUB (including e-mail), the Customer gives his express consent to be contacted by SM HUB or third parties who are couriers, merchants, partners of SM HUB and are providers of marketing services, state, municipal or non-governmental agencies or companies from the field of insurance or financial services, when this is provided by the specific legislation, as well as other companies with which SM HUB can develop common programs for offering the Goods and/or Services on the market, etc.
By providing his personal data to SM HUB, the Client gives his express consent to be included in the SM HUB database and gives his express and unequivocal consent to these data being stored, used and processed according to the purposes mentioned in item 11.1.
11. Advertising
- The moment the Customer creates an account on the Platform, he has the opportunity to express his consent to receive Newsletters.
The Customer may opt out of receiving a Newsletter at any time using the special link found in each Newsletter, by changing the settings in his account or by contacting SM HUB in any other way, including but not limited to e-mail, by phone at (+359) 877403344, by mail at ugoman.shop@gmail.com, etc.
The refusal to receive Newsletters does not mean an automatic refusal of the given consent to enter into this contract.
12. INVOICING – PAYMENT
- The prices of the Goods and Services announced on the Platform are final and include VAT, as well as all other taxes and fees provided for in the current Bulgarian legislation.
The price, method of payment and payment term for issuing invoices are specified in each Order.
The customer is obliged to provide all the necessary information for issuing the invoice in accordance with the current Bulgarian legislation.
The Seller will issue the Customer an invoice for the ordered and delivered Goods / services provided based on the information provided by the Customer.
SM HUB issues an invoice for each payment under an Order through which the Customer has purchased Goods and/or Services offered on the Platform by SM HUB. The customer is delighted to receive such an invoice electronically (by email or by uploading it to his account). In the event that these payment documents are not available for more than 48 hours (forty-eight) hours, please notify us at the email address smhub2.0@gmail.com or at (+359) 877403344
In order to correctly draw up the invoice for the relevant Order, the Customer is obliged to continuously update the data in his account. He must review the information provided in the relevant Order to ensure that it is complete, true and accurate.
13. STOCK DELIVERY
- The Seller undertakes to deliver the ordered and purchased Goods himself or through a courier company to an address specified by the Buyer or to an office of the courier company, depending on the Customer’s choice.
The Seller will ensure the appropriate packaging of the Goods and the dispatch of the accompanying documents. If by any chance the shipment contains a document necessary for the ordered product, please contact us at smhub2.0@gmail.com and we will do our best to provide it to you as quickly as possible.
SM HUB will deliver the Goods and provide the Services on the territory of Bulgaria and the European Union. The terms and price of delivery of SM HUB goods will be brought to the attention of the Customers in the relevant page for terms of delivery in the Platform.
14. GOVERNING LAW – JURISDICTION
- This contract is subject to Bulgarian legislation. Any disputes arising between SM HUB and the Clients will be resolved by mutual agreement or if this is impossible, the disputes will be resolved before the competent Bulgarian courts in the Municipality of Sofia.
